1. Acceptance of Terms
By creating an account or using our services, you agree to these Terms, our Privacy Policy, and any additional terms that may apply. If you do not agree to these Terms, do not use our services.
2. Description of Service
YouAreTheBest.Mom provides a platform for creating personalized tribute websites dedicated to celebrating mothers. Our services include:
- Custom subdomain for your tribute site (e.g., yourname.youarethebest.mom)
- Photo gallery hosting
- Quote and message display
- Theme customization
- Lifetime hosting (subject to the terms herein)
3. Account Registration
To use our services, you must:
- Be at least 13 years of age
- Provide accurate and complete registration information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Verify your email address
You may not use another person's account without permission or create accounts for fraudulent purposes.
4. Payment and Refunds
Our services require a one-time payment for lifetime access. By making a payment, you agree that:
- All payments are processed securely through Stripe
- Prices are subject to change for new customers
- Refunds may be requested within 30 days of purchase if you are unsatisfied
- Refund requests should be sent to support@youarethebest.mom
5. User Content
You retain ownership of the content you upload ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content solely for the purpose of providing our services.
You represent and warrant that:
- You own or have the right to use all content you upload
- Your content does not infringe on the rights of any third party
- Your content complies with these Terms and applicable laws
6. Prohibited Content and Conduct
You agree not to upload, post, or transmit any content that:
- Is illegal, harmful, threatening, abusive, harassing, or defamatory
- Contains nudity, sexually explicit material, or pornography
- Promotes violence, discrimination, or hatred
- Contains profanity, obscenity, or vulgar language
- Infringes on copyrights, trademarks, or other intellectual property rights
- Contains malware, viruses, or harmful code
- Impersonates another person or entity
- Violates the privacy of others
We reserve the right to remove any content that violates these Terms and to terminate accounts of repeat offenders.
7. Subdomain Selection
When selecting a subdomain for your tribute site:
- Subdomains are assigned on a first-come, first-served basis
- Subdomains may not contain profanity, offensive terms, or trademark violations
- We reserve the right to reject or reclaim subdomains that violate our policies
- Reserved subdomains (www, api, admin, etc.) are not available
8. Site Inactivity and Removal
Important: To ensure the quality and sustainability of our service, we reserve the right to remove tribute sites that have been inactive for an extended period.
A site is considered inactive if there have been no account owner logins and no visitor traffic for a continuous period of twelve (12) months or more.
Before removing an inactive site, we will:
- Send a notification email to the registered account email address at least 30 days before scheduled removal
- Provide an opportunity to reactivate the site by logging in or responding to the notification
- Allow you to download your content before removal upon request
If we cannot reach you at the registered email address and the site remains inactive, the site and its associated content may be permanently deleted. We are not responsible for any loss of content due to site removal under this policy.
To prevent your site from being flagged as inactive, simply log in to your account or ensure your tribute site receives occasional visitors.
9. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We may:
- Perform maintenance that temporarily affects availability
- Modify or discontinue features with reasonable notice
- Suspend service for accounts that violate these Terms
10. Intellectual Property
The YouAreTheBest.Mom name, logo, and all related graphics, software, and content created by us are our property and protected by intellectual property laws. You may not use our branding without written permission.
11. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR OUR SERVICES.
13. Indemnification
You agree to indemnify and hold harmless YouAreTheBest.Mom and its affiliates from any claims, damages, losses, or expenses arising from your use of our services, your content, or your violation of these Terms.
14. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your account immediately if you violate these Terms. Upon termination:
- Your right to use our services will cease immediately
- We may delete your account and content
- We are not obligated to provide refunds for terminated accounts that violated these Terms
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending an email. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.
16. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and YouAreTheBest.Mom regarding our services.
